1. Acceptance of Terms
By accessing or using Noviqe ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users, including students, parents, guardians, and educators.
2. Description of the Service
Noviqe is an AI-powered educational platform for International Baccalaureate (IB) students. The Service may include:
- AI tutoring and study assistance
- Personalised study planning
- Original IB-style practice questions
- Progress tracking and analytics
- Study notes and learning materials
- Mock exams and feedback tools
We may add, modify, or remove features over time as we improve the Service.
3. User Accounts
3.1 Account Creation
Some features require an account. You agree to provide accurate, current, and complete information during registration and to keep your details up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or suspected breach of security.
3.3 Age Requirements
- The Service is intended for users aged 13 years and older.
- Users under 18 must have parental or guardian consent to use the Service.
- Users under 13 are not permitted to use the Service.
4. Subscription and Payments
4.1 Free Trial
New users may receive a 7-day free trial, with no payment required during the trial period. Trial access and eligibility may change from time to time.
4.2 Paid Subscriptions
After the trial, continued access to premium features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select.
We may update our pricing from time to time. If we change subscription fees, we will notify you in advance, and the changes will apply from your next billing cycle.
4.3 Cancellation and Refunds
You may cancel your subscription at any time. Your subscription remains active until the end of the current billing period. We do not provide refunds or credits for partial months or unused portions of subscriptions, except where required by applicable law.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws or regulations
- Access, tamper with, or use non-public areas of the Service or our systems
- Share your account or login credentials with others
- Use bots, scrapers, or any automated tools to access the Service
- Upload or transmit malware, viruses, or other malicious code
- Reproduce, distribute, or resell Service content without our written permission
- Use the Service to cheat, plagiarize, or violate school or IB academic policies
- Harass, abuse, or harm other users
We reserve the right to investigate and take action in response to suspected misuse of the Service.
6. Intellectual Property
6.1 Our Content
All materials on the Service—including text, graphics, practice questions, explanations, software, logos, trademarks, and branding—are owned by Noviqe or its licensors and are protected by copyright and other intellectual property laws.
You may not copy, modify, reproduce, distribute, or create derivative works based on our content without our prior written consent.
6.2 User Content
You retain ownership of content you submit to the Service, such as your written answers or notes. By submitting content, you grant Noviqe a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely for the purpose of providing and improving the Service.
7. AI-Generated Content
The Service provides AI-generated responses, explanations, recommendations, and feedback. While we aim for accuracy and usefulness:
- AI outputs may contain errors, omissions, or inconsistencies.
- AI-generated content should not be treated as official IB guidance or marking.
- Important academic decisions should be checked against official IB materials and teachers.
Any predicted grades or performance insights are estimates only and are not guarantees of actual exam results or future performance.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
Without limiting the above, we do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Any defects or errors will be corrected
- Content (including AI-generated content) will be accurate, complete, or reliable
- Use of the Service will lead to improved grades, exam results, or academic outcomes
9. Limitation of Liability
To the maximum extent permitted by law, Noviqe and its officers, employees, partners, and affiliates shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, or opportunities
- Loss of data or interruption of service
- Academic or exam-related losses or missed opportunities
- Damages arising from your reliance on AI-generated content
In any case, our total liability for any claim arising out of or relating to the Service will not exceed the amount you have paid to use the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or £0 if you have not made any payments.
10. Privacy & Data Protection
By using the Service, you agree to our data practices as described in our Privacy Policy. We process personal data in accordance with applicable privacy laws, including the GDPR where it applies.
11. Modifications to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice within the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
12. Termination
We may suspend or terminate your account or access to the Service at any time if:
- You violate these Terms or other applicable policies
- You misuse or abuse the Service
- We decide to discontinue all or part of the Service
Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms, such as intellectual property, limitations of liability, and dispute clauses, will continue to apply after termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Noviqe operates, without regard to conflict-of-law principles. The courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms.
